VestaVids - Original Clips, Sold Directly by Creators

1. Acceptance of Terms

By accessing or using VestaVids ("the Platform"), operated by Vesta Create, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform.

2. Eligibility

You must be at least 18 years of age to use VestaVids. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these terms.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for all activity that occurs under your account.

4. Creator Accounts

Creators are responsible for all content they upload to the Platform. By uploading content, you represent that you own or have the necessary rights to distribute that content. Creators set their own prices for clips, photo sets, and custom requests. VestaVids reserves the right to remove content that violates these terms.

5. Purchases and Payments

All purchases are final unless otherwise stated. Payments are processed through third-party payment providers. VestaVids is not responsible for payment processing errors by third-party providers. Creators are responsible for verifying manual payments and fulfilling purchases in a timely manner.

6. Prohibited Content

You may not upload, share, or distribute content that: involves minors in any capacity; is non-consensual; promotes violence or illegal activity; infringes on the intellectual property rights of others; or violates any applicable law or regulation. VestaVids reserves the right to remove any content and suspend or terminate accounts that violate these prohibitions.

7. Intellectual Property

Creators retain ownership of their content. By uploading content, creators grant VestaVids a non-exclusive license to host, display, and distribute the content through the Platform. Buyers receive a personal, non-transferable license to view purchased content. Redistribution, resale, or unauthorized sharing of purchased content is strictly prohibited.

8. Content Moderation

VestaVids reserves the right to review, moderate, and remove content at its sole discretion. We may suspend or terminate accounts that repeatedly violate our content policies. Users can report content that they believe violates these terms.

9. Third-Party Videos and Links

Content labeled “From the Web” or “Third-party video” is hosted and delivered by the identified source website. It is not a VestaVids Original, is not sold by VestaVids, and remains subject to the source website's availability and terms. Submission of a link does not transfer ownership to VestaVids or imply endorsement. We may disable an embed or remove a link at any time in response to safety, rights-holder, legal, or quality concerns.

10. Limitation of Liability

VestaVids is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Vesta Create shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.

11. Termination

We may suspend or terminate your account at any time for violations of these terms. You may delete your account at any time through your account settings. Upon termination, your right to access purchased content may be revoked.

12. Changes to Terms

We may update these Terms of Service from time to time. We will notify users of material changes via email or through the Platform. Continued use of the Platform after changes constitutes acceptance of the updated terms.
