Leaks happen

Almost every creator who sells clips for long enough finds one somewhere it should not be. It is manageable. The tools are the copyright you already hold, a standard notice procedure most sites follow, and good records.

What a takedown notice is

In the United States, the Digital Millennium Copyright Act (DMCA) gives websites protection from liability for what users upload, provided they remove infringing material promptly when the copyright holder notifies them. Many other countries have similar notice and takedown systems, and most large sites, wherever they are based, accept notices in the DMCA format because it is familiar.

A notice generally needs to:

  • Identify you as the copyright holder or someone acting for you.
  • Identify the work being infringed (your clip, with a link to the original listing if you have one).
  • Give the exact location of the infringing copy (the full URL of each page or file).
  • State in good faith that the use is not authorised.
  • State, under penalty of perjury, that the information is accurate and you are the holder or their agent.
  • Include your contact details and signature.

Sites usually publish a designated address or form for notices. Use it rather than general support. Send one notice per site listing every URL you found there.

Practical steps

  1. Record everything before it disappears: screenshots of the page showing the clip, the URL, the date, and the account that posted it.
  2. Find the site's copyright or DMCA contact. If none is listed, look up who hosts the site and notify the host.
  3. Send the notice with the details above.
  4. Keep a log: which site, which URLs, date sent, response, date removed.
  5. Search again periodically. Leaks resurface.

If the uploader files a counter-notice claiming a right to the material, the site may restore it unless you take further action. That is the point to ask a lawyer.

A notice includes your contact details, and some sites forward them to the uploader. Many creators use a business name and a dedicated email, or a takedown service or agent to send notices on their behalf so personal details never appear.

Limiting the damage

Watermarks that identify your store make leaked copies advertise you and make proving ownership simpler. Keeping raw footage and project files proves the clip is yours. Telling buyers plainly that purchases are for personal viewing sets the expectation.

Do not confront uploaders publicly or post about the leak with links; it spreads the copy. If a buyer tells you about a leak, thank them and get the URL. If you suspect a specific buyer leaked a custom, your records of who bought what are your evidence.

The specifics of notices, counter-notices, deadlines and remedies vary by country and change over time. For anything beyond a routine notice that is honoured, ask a lawyer who handles copyright for adult creators.
